Dual-Use Controls: What Ships, and What Waits

How to tell whether a consignment needs an export authorisation, and what it costs the deployment window to find out late.

Why AI hardware is in scope

Dual-use goods are items with both civilian and military application. High-performance computing hardware has been squarely inside that definition since the export control lists were revised around AI accelerators; ECCN 4A090 is the heading most current training and inference hardware is assessed against. The practical consequence is that an export authorisation can be a precondition for movement rather than a formality collected afterwards – and whether it is depends on the destination, the parties, the end user and the end use as much as on the classification.

The assessment is per line, not per shipment

A cluster is not one product. Compute nodes, storage shelves, switching, PDUs and cooling equipment are separate lines with separate headings, separate origins and separate control status. One controlled line makes the whole consignment a controlled movement. A packing list that says "computer equipment" is not a classification, and it will not survive scrutiny at either border.

US-origin content travels with the goods

Re-export control follows US-origin content between third countries. A shipment that never touches the United States can still require a US authorisation because of what is inside it. This has to be assessed before booking: the alternative is discovering it when the consignment is already in bond in a country whose authority now has questions.

What it costs to find out late

An authorisation takes ten to forty-five days depending on the authority and the destination. Found early, that runs in parallel with the freight plan and costs nothing. Found after the goods have moved, it is an unlicensed export – an offence attributed to the exporter of record, not to the person who forgot to ask – and the goods sit in bond, accruing demurrage, while it is resolved.

A workable sequence

Classify the bill of materials line by line and record the reasoning. Screen the parties and the components. Determine control status and identify every authorisation required, in every jurisdiction the goods touch. Apply, in parallel with freight planning. Book only once the licence position is known. It is slower for the first week and faster for every week after it.
